Legislature of Health Information Exchange in Emergency Medical Service System

Abstract
|
|
|
Health Information Exchange(HIE) is the electronic movement of health-related information among organizations according to nationally recognized standards. The benefit of HIE is to facilitate access to and retrieval of clinical data to provide safer, timelier, efficient, effective, equitable, patient-centered care. Emergency physicians often must make critical, time-sensitive decisions with a paucity of information with the realization that additional unavailable health information may exist. HIE in Emergency Medical Service System(EMSS) might have an important impact on the practice of emergency medicine.
Legal basis of HIE in EMSS are Medical Service Act, Act on 119 Rescue and Emergency Medical Service, Emergency Medical Service Act as National Emergency Data Information System. And there are legal requirement of inter-hospital transfer for HIE.
This article includes medico-legal aspects of HIE in EMSS to facilitate HIE"s purpose and demonstrate its value and to consider the right to self- determination of health information and privacy of emergency patient.
It is necessary that legislature on HIE in EMSS should be applied and interpreted for the proper balance between maximizing the benefit of HIE in EMSS and minimizing its risk.
